While the distinction might sound like standard legal terminology, it plays a critical role in determining contractor liability, insurance coverage, repair responsibility, and statute of limitations. Understanding the difference between a patent and a latent construction defect is essential for property owners, AOAO boards, and real estate professionals.
1. Patent Construction Defects: Visible and Obvious
A patent defect is a construction deficiency that is observable or discoverable through a reasonable, standard visual inspection. It does not require specialized destructive testing, thermal imaging, or forensic equipment to spot; it is apparent to the naked eye or easily identifiable upon basic observation.
Common Examples of Patent Defects:
Visible Structural Cracking: Pronounced vertical or horizontal cracks on exposed concrete walls, driveways, or exterior finishes.
Surface Water Pooling: Standing water on flat roofs or walkways immediately following rain due to improper sloping.
Flawed Finishes & Aesthetics: Misaligned cabinetry, uneven floor tiles, damaged drywall, or improperly hung doors.

2. Latent Construction Defects: Hidden and Concealed
A latent defect is a hidden or concealed flaw in design, materials, or workmanship that is not discoverable through a standard visual walkthrough. These issues often remain trapped inside walls, beneath foundations, or under waterproof membranes for months—or even years—before manifesting through secondary structural damage.
Common Examples of Latent Defects:
Leaking Windows: Sub-surface leaks caused by improper internal window flashing, degraded concealed sealant, or installation errors that allow water to enter wall cavities before showing visible damage inside.
Concrete Spalling ("Concrete Cancer"): Internal corrosion of steel rebar buried deep within concrete slabs that gradually expands and causes catastrophic cracking over time.
Sub-Surface Waterproofing Failures: Missing or incorrectly installed membrane flashings behind exterior stucco, EIFS, or siding that lead to hidden framing rot and internal mold growth.
Defective Plumbing Systems: Failing concealed cast iron pipes, improper drain slopes hidden behind drywall, or sub-floor pipe leaks.
Foundation & Sub-grade Settling: Inadequate soil compaction or improper footings subterraneanly located that eventually lead to major structural shifting years down the road.

Because they cannot be seen during standard handovers, state statutes of repose and discovery rules generally give property owners a broader window of time to file legal claims once the defect is finally uncovered or manifests through physical damage.
